(the “Company,” “we” or “us”) operates a website located at www.inadco.com (the “Site”) and other software code (the “Forms”) placed on websites and web pages of third parties (together, the “Third Party Sites”). Through the Site and the Forms, we provide advertising services for customers on the internet (collectively, with all other services provided by the Company, the “Services”). The following Terms of Use set forth legally binding terms for your use of the Site, the Forms and the Services. The following Privacy Policy details the Company’s practices regarding your Personal Data (as defined below) that we collect through the Site and the Forms. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR (AND OUR SUPPLIERS’) LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO THIS AGREEMENT (FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION), WILL AT ALL TIMES BE LIMITED TO FIFTY US DOLLARS ($50). 5. Indemnification. You shall indemnify and hold harmless, Company and its officers, managers, members, employees, agents, representatives, third-party content providers, designers, contractors, distributors, merchants, sponsors, licensors, successors and assigns, or the like (collectively, the "Indemnified Parties") from any breach of the Terms of Use by you, including any use of Content. You agree that the Indemnified Parties shall have no liability in connection with any such breach or unauthorized use, and you agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses, and reasonable attorneys' fees, of the Indemnified Parties in connection therewith. You shall also indemnify and hold harmless the Indemnified Parties from and against any claims brought by third parties arising out of your use of the information accessed from the Site or Forms. 6. Changes to Terms of Use. We reserve the right, at any time and without notice, to add to, update, change, modify or revise the Terms and Use, by posting such change. Any such addition, update, change, modification or revision will be effective immediately upon posting on the Site. Your continued use of this website and submission of the Forms, following the posting of any updates or changes to the Terms of Use constitute your acceptance of such changes. If you object to any provision of the Privacy Policy or Terms of Use or any subsequent modifications, your only recourse is to immediately terminate use of this Site, the Forms and the Services. 7. Governing Law. The Site and Forms are created, owned and operated by Company with its principal place of business in the State of California. As such, the Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to the Terms of Use shall be filed only in the state or federal courts located in San Francisco, California, and you hereby submit to the personal jurisdiction of such courts. Any provision of the Terms of Use that is determined for any reason to be unlawful, invalid, void, or for any reason unenforceable, shall not affect any other portion of the Terms of Use.

Should you decide to opt-out of receiving future mailings, Company or Partners may share your e-mail address with third parties to ensure that you do not receive further communications from third parties. If you no longer wish to receive cookie-targeted online ads from Inadco’s ad network, you can follow the Consumer Opt-Out Program detailed below. 8. Right to Transfer. All or any of Company’s rights and obligations under this Agreement may be assigned to a subsequent owner or operator of the Site, Forms or Services in a merger, acquisition, or sale of all or substantially all of Company’s assets. You may not assign or transfer this Agreement or any or all of your rights hereunder, without the prior written consent of Company, and any attempt to do so is void. 9. Email. When you fill out one of our Forms, you are consenting to receive email that informs you about new products and services. In addition, we may send you email to help us learn more about you and your preferences. If for any reason, after you have shared your email address with
the Company, you decide that you do not want to receive email from
the Company, you can discontinue email from the Company by clicking
on the hyperlink shown in all Company emails and follow the directions
to indicate your unsubscribe preference. If you have registered
or submitted information under more than one email account, you
must submit separate unsubscribe requests from each account. Once
we receive your request, we will take reasonable efforts to remove
you from future general email notice lists we maintain. However,
because these lists are sometimes prepared in advance, it may take
a short period of time for the email address you identify in your

California Law permits California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. This Privacy Policy applies to all Personal Data collected by or submitted to the Company. Other affiliated entities of the Company may obtain information independently from transactions and experiences with you or from other sources. This Privacy Policy does not pertain to that information. 13. Communication With Children. We recognize the unique privacy concerns regarding children. We are committed to carefully protecting privacy where children are involved no matter the point of contact. In particular, our intention is to fully comply with the Children’s Online Privacy Protection Act (COPPA). Per COPPA guidelines, we do not knowingly collect personally identifiable information from children under the age of 13. If a parent or guardian is made aware that a child under the age of 13 has provided us with personally identifiable information through any point of contact, we ask to be contacted at the above address or by email via the Contact Us link and we will delete the information about the child referenced from our files. 14. Your Consent. By visiting the Site or using the Forms or Services, you consent and agree to the Company using the information, including all Personal Data and Anonymous Data, collected or submitted as described in this Privacy Policy. We reserve the right to periodically revise this Privacy Policy so we encourage you to review it periodically and your use of this website is deemed to be your acceptance. 15. Security. The Company uses industry standard security techniques on the Site and Forms to help protect against the loss, misuse or modification of information we’ve collected from you. When you transmit personally identifiable data to us, that information is stored on servers that we have protected from unauthorized access or intrusion. While we encrypt data and strive to protect your information, the Company cannot ensure or warrant the security of any information you transmit to us. While we make every effort to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third party “hackers” from illegally obtaining this information.
